1. Acceptance of Terms

By accessing or using the website at parkingnesia.id or any SmartPark products and services provided by PT Parkingnesia Jaringan Raya ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, please discontinue use of our website and services immediately.

2. Our Services

PT Parkingnesia Jaringan Raya provides smart parking management solutions including, but not limited to:

• Parking management software (SmartPark platform)
• Hardware integration services (gates, sensors, displays, RFID readers)
• System installation, configuration, and commissioning
• Ongoing technical support and maintenance
• Training and consultation services

Service specifications are defined in individual service agreements or proposals issued to each client.

3. Eligibility

Our services are intended for businesses and organizations. By using our services, you represent that:

• You are at least 18 years of age
• You have the legal authority to bind yourself or your organization to these Terms
• Your use of our services complies with all applicable laws and regulations

4. Account & Responsibilities

Clients granted access to SmartPark's online dashboard or management system are responsible for:

• Maintaining the confidentiality of login credentials
• All activities that occur under their account
• Promptly notifying us of any unauthorized access or security breach
• Ensuring accurate and up-to-date account information

We are not liable for any loss resulting from unauthorized use of your account credentials.

5. Acceptable Use

You agree not to use our services to:

• Violate any applicable law or regulation
• Transmit harmful, offensive, or illegal content
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the integrity or performance of our services
• Reverse-engineer, decompile, or disassemble any part of our software
• Resell or sublicense our services without prior written consent

6. Intellectual Property

All content, software, logos, trademarks, and materials available through our website and services are the exclusive property of PT Parkingnesia Jaringan Raya or its licensors, protected by Indonesian and international intellectual property laws.

No portion of our materials may be reproduced, distributed, or used for commercial purposes without our express written permission.

Clients are granted a limited, non-exclusive, non-transferable license to use the SmartPark platform solely for their internal business operations as specified in their service agreement.

7. Payment & Billing

Payment terms are defined in individual service proposals or contracts. General conditions include:

• All fees are quoted in Indonesian Rupiah (IDR) unless otherwise stated
• Invoices are due within the payment period specified in your contract
• Late payments may incur interest charges as permitted by applicable law
• We reserve the right to suspend services for overdue accounts
• All taxes applicable under Indonesian law are the responsibility of the client

8. Termination

Either party may terminate a service agreement in accordance with the notice period specified in the contract. We may immediately suspend or terminate access to our services if:

• You materially breach these Terms or your service agreement
• You fail to make payments when due
• We are required to do so by law or regulation
• Continuing to provide services would expose us to legal or reputational harm

Upon termination, your right to use our services ceases immediately. Data export requests must be submitted before the termination effective date.

9. Disclaimer of Warranties

Our website and services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that our services will be uninterrupted, error-free, or completely secure.

10. Limitation of Liability

To the maximum extent permitted by Indonesian law, PT Parkingnesia Jaringan Raya shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — our services.

Our total cumulative liability to you for any claims arising out of or related to these Terms shall not exceed the amounts paid by you to us in the three (3) months preceding the event giving rise to the claim.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Indonesia.

Both parties agree to attempt good-faith resolution of any dispute before initiating formal legal proceedings.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will indicate the date of the latest revision at the top of this page. Your continued use of our services after changes are posted constitutes your acceptance of the revised Terms.

For material changes, we will make reasonable efforts to notify active clients via email or in-platform notification.
